Terms for using Aqualink websites, platforms, and services.

These terms are prepared for Bangladesh-based operations and international business relationships involving our IoT, automation, software, and service work.

Website and service use

These terms cover use of our website, communications, proposals, products, platforms, and related services unless a signed agreement says otherwise.

Bangladesh governing law

Aqualink is based in Bangladesh. These terms are framed for Bangladesh operations while supporting international business users.

Operational responsibility

Connected systems require proper installation, user access control, site readiness, maintenance, and responsible operational decisions.

1. Acceptance of terms

These Terms of Use apply to the website, digital content, communications, proposals, platforms, products, and services provided by Aqualink Bangladesh Limited.

By accessing our website, requesting information, using our services, or interacting with our platforms, you agree to these terms. If a signed contract, proposal, statement of work, purchase order, service level agreement, or data processing agreement applies, that document will control where it conflicts with these terms.

2. About Aqualink services

Aqualink designs and delivers IoT, automation, energy intelligence, software, dashboards, sensor integrations, cloud systems, mobile applications, reporting tools, and operational technology solutions.

Service scope, deliverables, timelines, pricing, support levels, warranty terms, hosting arrangements, data responsibilities, and maintenance obligations should be defined in the applicable written proposal or agreement.

3. Eligibility and business use

Our website and services are intended for business, institutional, operational, professional, and organizational use. You represent that information you provide is accurate and that you have authority to act for the organization you represent.

International users are responsible for ensuring that their use of our website, platforms, or services is permitted under the laws and regulations applicable to their location and industry.

4. User responsibilities

You agree not to misuse the website or services, attempt unauthorized access, interfere with systems, submit false information, copy protected material without permission, or use Aqualink platforms for unlawful or harmful purposes.

For deployed systems, clients are responsible for site access, stable power and connectivity where required, physical protection of devices, safe operational procedures, authorized user access, and timely reporting of issues.

5. Proposals, pricing, and payment

Website descriptions are general and do not guarantee availability, pricing, exact features, savings, outcomes, or delivery timelines. Formal commitments must be confirmed through an approved proposal, invoice, purchase order, or signed agreement.

Fees, taxes, payment schedules, late payment consequences, renewal terms, and cancellation terms will be governed by the relevant commercial document. Unless stated otherwise, prices may exclude VAT, duties, bank charges, installation expenses, travel costs, or third-party service costs.

6. Product performance and operational outcomes

Aqualink designs systems to improve visibility, control, automation, and decision-making. However, actual outcomes depend on site conditions, user behavior, equipment condition, connectivity, maintenance, process discipline, and other factors outside our control.

Energy savings, efficiency gains, uptime improvements, and productivity outcomes mentioned on the website are examples or targets, not guaranteed results unless expressly agreed in writing.

7. IoT devices, telemetry, and data

IoT and automation systems may collect sensor readings, device status, event logs, telemetry, user actions, alerts, reports, and operational data. Data handling is also described in our Privacy Policy and any project-specific agreement.

Clients should not rely solely on digital dashboards for safety-critical decisions unless the system has been expressly designed, tested, and contracted for that purpose. Human supervision and site safety procedures remain important.

8. Intellectual property

The Aqualink name, logo, website content, designs, software, documentation, product concepts, dashboards, graphics, code, and related materials are owned by Aqualink or its licensors unless otherwise stated.

Clients receive only the rights expressly granted in the applicable agreement. No rights are transferred by website access, proposal review, demo access, or general communication.

9. Third-party services

Our solutions may use third-party cloud, connectivity, hosting, analytics, maps, communication, payment, device, API, or software services. Those services may be subject to separate terms, availability limits, pricing, and security practices.

Aqualink is not responsible for third-party outages, policy changes, price changes, or failures outside our reasonable control, except where a written agreement provides otherwise.

10. Confidentiality

Information exchanged during proposals, demonstrations, deployment, support, or technical discussions may be confidential. Each party should protect confidential information with reasonable care and use it only for the relevant business purpose.

More detailed confidentiality obligations may be included in a non-disclosure agreement, service agreement, or project contract.

11. Warranty and disclaimers

The website is provided for general information. We try to keep information accurate and useful, but we do not guarantee that the website will always be complete, error-free, uninterrupted, or current.

To the fullest extent permitted by applicable law, services and products are provided according to the warranties expressly stated in the applicable written agreement. Other implied warranties are excluded where legally permitted.

12. Limitation of liability

To the fullest extent permitted by law, Aqualink will not be liable for indirect, incidental, special, consequential, punitive, or business interruption losses arising from website use, service use, system downtime, data loss, or operational decisions.

Where liability cannot be excluded, it will be limited to the amount permitted by applicable law or the amount stated in the relevant contract.

13. Force majeure

Aqualink is not responsible for delay or failure caused by events beyond reasonable control, including natural disasters, fire, flood, strike, civil disturbance, war, government action, internet outage, utility failure, import restriction, epidemic, supplier failure, or third-party platform disruption.

14. Governing law and disputes

Unless a separate agreement states otherwise, these terms are governed by the laws of Bangladesh. The courts of Bangladesh will have jurisdiction over disputes, subject to any arbitration or dispute resolution clause in an applicable written agreement.

For international projects, the governing law, dispute forum, tax treatment, data transfer terms, and service-level commitments should be confirmed in the applicable contract.

15. Updates to these terms

We may update these Terms of Use from time to time. The updated version will be posted on this page with a revised date. Continued use of the website or services after updates means you accept the revised terms.
